Shabana Mahmood has set out plans to overhaul immigration rules.<\/b><\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Proposals to change the requirements to qualify for permanent settlement in the UK were first outlined in detail in November 2025, when Mahmood was home secretary in Sir Keir Starmer&#8217;s government.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Following a consultation, Mahmood has now announced her final decision on what changes should be taken forward.<\/p>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<div data-block=\"links\" known as settlement \u2013 gives someone the right to live, work and study in the UK for as long as they like.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Under the current system, people with ILR can also apply for benefits if they are eligible.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">People who have lived in the UK for 12 months after being given ILR can apply for British citizenship, if they also meet other requirements.<\/p>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<div data-block=\"subheadline\" class=\"ssrcss-vxwoax-ComponentWrapper e1aon0op1\">\n<div role=\"text\">How will the new rules affect migrants?<\/span><\/h2>\n<\/div>\n<\/div>\n<\/div>\n<div data-block=\"text\" class=\"ssrcss-vxwoax-ComponentWrapper e1aon0op1\">\n<div class=\"ssrcss-126h8e-Spacer e1aon0op0\">\n<div data-testid=\"rich-text\">\n<div class=\"ssrcss-nqezkk-RichTextContainer e5tfeyi1\">\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Under the government&#8217;s plans, the standard length of time migrants will have to live in the UK to qualify for permanent settlement will double from five to 10 years.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Under this 10-year pathway, applicants must have earned at least \u00a312,571 for five of the seven years immediately before being granted settlement.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">However, there will be a shorter qualifying period of five years for certain groups, including:<\/p>\n<div class=\"ssrcss-2st5ed-ListContainer e5tfeyi0\">\n<ul role=\"list\">\n<li>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">People who earned at least \u00a350,271 for three of five years immediately before applying for settlement<\/p>\n<\/li>\n<li>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Care workers who earned at least \u00a325,000 a year while meeting their visa conditions and arrived in the UK before May 2025<\/p>\n<\/li>\n<li>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">&#8220;Skilled&#8221; public service workers, such as doctors, nurses and teachers<\/p>\n<\/li>\n<li>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Other health and education public service workers who fall below this skill level, for example nursing auxiliaries and teaching assistants, if they arrived in the UK before May 2025<\/p>\n<\/li>\n<li>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">People from Hong Kong who hold British National (Overseas) status<\/p>\n<\/li>\n<\/ul>\n<\/div>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">People earning over \u00a3125,141 a year, as well as &#8220;highly skilled&#8221; migrants such as those on Global Talent or Innovator Founder visas, will qualify after three years.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Migrants who have claimed certain benefits or breached immigration rules will only be able to settle after at least 20 years.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">To qualify for settlement, migrants will also have to meet other conditions including:<\/p>\n<div class=\"ssrcss-2st5ed-ListContainer e5tfeyi0\">\n<ul role=\"list\">\n<li>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Have no criminal record<\/p>\n<\/li>\n<li>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Speak English to a high standard<\/p>\n<\/li>\n<li>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Owe no debt to the taxpayer<\/p>\n<\/li>\n<li>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Have &#8220;a record class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">There will be a different set of rules for refugees \u2013 people who have been granted asylum in the UK because they are unable to return to their own country as they fear persecution.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Refugees who arrived in the UK through an official government scheme will qualify for settlement after five years.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">However, other refugees will need to wait 10 years and either work or study.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Those who do not work or study will need to wait 20 years.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Refugees who arrived in the UK by small boat or another illegal route will have to wait 20
